These Terms of Service (“Terms”) govern your use of this website and any purchase you make from it. The site is operated by COMOGLU LLC (“Noce,” “we,” “us”). By using the site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By ordering, you confirm the information you give us is accurate and that you're authorized to use the payment method you provide.

2. Products and descriptions

We work to describe our products accurately and to show colors and dimensions faithfully. We can't guarantee that your screen displays colors exactly, and packaging or minor design details may change. Product availability is not guaranteed, and we may limit quantities or discontinue a product at any time.

3. Pricing and errors

All prices are listed in U.S. dollars and may change without notice. Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If that happens, we may cancel the order and refund you in full, even after you've received an order confirmation.

4. Orders and payment

Your order is an offer to buy. We accept it when we ship the product. We may refuse or cancel any order — for example, if a product is out of stock, if we suspect fraud, or if there's an error in the listing. If we cancel an order you've paid for, we refund you in full.

Applicable sales tax is calculated and added at checkout.

5. Shipping, title, and risk of loss

We ship with USPS within the United States. Shipping terms are described in our Shipping Policy. Title and risk of loss pass to you when the carrier delivers the package. If a package is lost or damaged in transit, contact us and we'll open a claim and make it right.

6. Returns and refunds

Returns are governed by our Refund & Return Policy, which is part of these Terms.

7. Warranty

Products are covered by the limited warranty described on our Warranty page. Except as stated there and as required by law, products are provided “as is.”

8. Safe use

Our appliances generate heat, steam, and pressure. Read the included manual before first use and follow all safety instructions. Use the product only for its intended purpose, on surfaces the manual identifies as suitable, and only with the voltage and plug type it's rated for. We're not responsible for damage or injury caused by misuse or by ignoring the instructions.

9. Acceptable use

You agree not to use the site to break any law, infringe anyone's rights, transmit malware, scrape or harvest data, interfere with the site's operation, or attempt to gain unauthorized access to our systems. We may suspend or terminate access for any violation.

10. Accounts

If you create an account, you're responsible for keeping your password confidential and for activity that happens under it. Tell us right away if you suspect unauthorized use.

11. Intellectual property

All content on this site — text, photography, video, graphics, logos, and the Noce name — is owned by us or our licensors and protected by intellectual property law. You may not copy, reproduce, or use it commercially without our written permission.

12. User content

If you submit a review, photo, video, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our business, including marketing. You confirm the content is yours to share and doesn't infringe anyone's rights. We may remove content at our discretion.

13. Third-party links and services

The site may link to or rely on third-party sites and services. We don't control them and aren't responsible for their content, products, or practices.

14. Disclaimers

The site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms or on our Warranty page, including implied warranties of merchantability and fitness for a particular purpose. We don't warrant that the site will be uninterrupted or error-free.

15. Limitation of liability

To the fullest extent permitted by law, Noce is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or our products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

Some states don't allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold Noce harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the site or our products.

17. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Dutchess County, New York, and you consent to their jurisdiction.

18. Severability

If any provision of these Terms is found unenforceable, the rest stays in effect.

19. Changes to these Terms

We may update these Terms at any time. The revision date at the top reflects the current version, and continued use of the site means you accept the update.
